We may update these Terms from time to time. Updates are effective when posted. Your continued use of the website or continued ordering after updates are posted constitutes acceptance of the revised Terms.
All quotes are subject to supplier availability, production capacity, and verification at time of order acceptance. Prices, freight estimates, and availability may change without notice prior to order acceptance.
We reserve the right to correct typographical, pricing, product, photographic, or technical errors and to cancel or revise affected orders.
All orders are subject to acceptance by Spectrum Advertising. Submission of an order request or receipt of an email confirmation does not constitute final acceptance.
Production begins only after all required approvals are completed, including: final proof approval (where applicable), and required payment/deposit authorization.
When a proof is provided, the customer is responsible for reviewing and approving all details, including spelling, grammar, layout, color selection, imprint size, and placement.
Once approved, changes may not be possible or may result in additional charges and delays.
We accept approved payment methods, including major credit cards, and other methods as agreed in writing. All amounts are in U.S. dollars unless otherwise stated.
For approved credit card transactions, charges may be processed at the time specified in your order terms.
Customer agrees to pay all applicable charges, including product, decoration, setup, freight, taxes, duties, and other stated fees.
Customer is responsible for applicable sales/use taxes unless a valid exemption certificate is provided before invoicing.
For international shipments, customer is responsible for customs duties, VAT/GST, brokerage, and import-related charges unless explicitly stated otherwise in writing.
Production and delivery dates are estimates, not guarantees. Delays may occur due to supplier constraints, shipping carriers, customs, weather, and other factors beyond our control.
Industry-standard overrun/underrun may apply. Unless otherwise stated on your quote/order confirmation, quantities may vary by up to +/-10%, and invoicing will reflect actual shipped quantity.
Unless otherwise stated in writing, all shipments are FOB Shipping Point (Origin). Title and risk of loss transfer to customer when goods are delivered to the carrier for shipment.
Carrier transit delays, damage, or loss are the carrier’s responsibility once shipment is tendered, subject to applicable law and carrier terms.
Customer must inspect all goods immediately upon receipt.
Damage/shortage/defect claims must be reported within 3 business days of delivery with supporting photos and shipment details.
Custom/imprinted products are non-returnable except for verified manufacturing defects or fulfillment errors attributable to us/supplier.
Unimprinted, unused items in original packaging may be eligible for return only with prior authorization and may be subject to restocking fees (including up to 15%) and freight charges.
Additional return conditions are in our Shipping & Returns Policy, which is incorporated into these Terms.
If cancellation or change is requested after approval and/or production release, customer is responsible for costs incurred to date, including but not limited to setup, production, artwork, restocking, shipping, and administrative charges.
A minimum cancellation/administrative fee may apply.
Customer represents and warrants that it owns or has all rights, licenses, and permissions necessary for any logos, trademarks, text, artwork, or other materials submitted for production.
Customer agrees to indemnify and hold Spectrum Advertising harmless from claims arising from customer-provided content, including intellectual property claims.
Website content is provided for general information and may be changed without notice. You agree not to misuse the website, interfere with operations, or attempt unauthorized access.
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Spectrum Advertising will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits/revenue/business interruption.
Our aggregate liability for any claim related to a specific order will not exceed the amount paid by customer for the affected order.
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, labor disruptions, supplier failures, transportation delays, governmental actions, cyber incidents, or utility/infrastructure outages.
Any dispute arising out of or related to these Terms, website use, or purchases from Spectrum Advertising will be resolved by binding arbitration administered by the American Arbitration Association, in Colorado, except claims eligible for small claims court.
You and Spectrum Advertising waive the right to jury trial and to participate in class or representative actions.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, subject to applicable federal law.
Use of personal information is governed by our Privacy Policy. By providing contact information, you consent to receive transactional communications related to quotes, orders, and service. Marketing communications are optional where required by law and include opt-out mechanisms.
These Terms, together with any accepted quote/order confirmation and posted policies (including Privacy Policy and Shipping & Returns), constitute the entire agreement between customer and Spectrum Advertising regarding website use and purchases.
If any provision is found unenforceable, remaining provisions remain in effect.
